Throughout these Terms of Service, "Dark Frog TCG", "we", "us", and "our" refer to Dark Frog Studios trading as Dark Frog TCG.

2. Applicability

These Terms of Service apply to all offers, orders, purchases, deliveries, and agreements made through the Dark Frog TCG webshop.

By placing an order, the customer agrees to these Terms of Service.

If any provision is found to be invalid or unenforceable, all remaining provisions remain fully effective.

3. Products

Dark Frog TCG sells trading card game products, including but not limited to:

  • Magic: The Gathering
  • Pokémon
  • Disney Lorcana
  • One Piece Card Game
  • Accessories
  • Singles
  • Sealed products
  • Merchandise

Product images are provided for illustrative purposes. Actual products may differ slightly due to manufacturer updates, print variations, or packaging changes.

4. Orders and Contract Formation

An order becomes binding only after Dark Frog TCG has accepted the order and payment has been successfully authorized.

We reserve the right to refuse or cancel orders in cases including but not limited to:

  • Pricing errors
  • Stock inaccuracies
  • Fraud prevention measures
  • Payment issues
  • Suspicious purchasing patterns
  • Technical website errors

If payment has already been received for a canceled order, a full refund will be issued.

5. Pricing

All prices displayed are inclusive of VAT where applicable.

Shipping costs are displayed during checkout before the order is finalized.

Dark Frog TCG reserves the right to adjust pricing without prior notice. Price changes do not affect orders already accepted.

6. Availability and Stock

Although we strive to maintain accurate inventory levels, stock discrepancies may occur.

A product shown as available does not guarantee availability until the order has been confirmed.

If a product becomes unavailable after purchase, we may:

  • Issue a full refund;
  • Offer a substitute product;
  • Offer store credit.

The customer may choose between these options where legally required.

7. Payment

Payment must be completed before shipment unless another arrangement has been agreed in writing.

Accepted payment methods are displayed during checkout.

Orders will not be dispatched until payment has been successfully received.

8. Shipping and Delivery

Orders are generally shipped via PostNL.

Estimated delivery times are indicative only and are not guaranteed.

Dark Frog TCG is not responsible for delays caused by:

  • Postal carriers
  • Customs authorities
  • Force majeure events
  • Incorrect customer information

Risk of loss passes to the customer upon delivery.

9. Local Home Delivery

Customers located in Almere and Lelystad may select local home delivery where available.

Delivery fees are calculated during checkout.

The same consumer rights and return policies apply to locally delivered orders.

Returned products must be shipped back to the designated return address. Personal collection of returns is not offered.

10. Pre-Orders

Products offered as pre-orders are subject to manufacturer allocations, supply chain delays, and release date changes.

Release dates published by manufacturers may change without notice.

Dark Frog TCG cannot be held liable for:

  • Delayed releases
  • Reduced allocations
  • Product cancellations by distributors

If a pre-order cannot be fulfilled, the customer will be entitled to a refund of the amount paid for the unavailable items.

11. Trading Card Products

Collectible card products may contain randomized contents.

Dark Frog TCG cannot guarantee:

  • Specific cards
  • Specific card values
  • Investment potential
  • Pull rates
  • Future market prices

Purchases are made with the understanding that randomized products contain elements of chance determined solely by the manufacturer.

12. Singles and Card Condition

Individual cards are sold according to the condition stated in the product description.

Minor manufacturing defects, centering differences, or print variations are not considered defects unless specifically described.

Condition assessments are made in good faith using industry standards but remain subjective.

Dark Frog TCG does not guarantee that cards will receive any particular grading result from third-party grading companies.

Differences between our assessment and a third-party grading outcome do not constitute grounds for refund, replacement, or compensation.

13. Right of Withdrawal

Consumers have the statutory right to withdraw from their purchase within 14 days of receiving the goods, subject to applicable Dutch and European consumer protection law.

14. Returns and Refunds

Returns are governed by our Return Policy.

Returned products may be inspected upon receipt.

Refunds may be reduced where products have suffered a loss in value due to handling beyond what is necessary to establish their nature, characteristics, and functioning.

15. Promotional Items

Free promotional items, bonus products, and gifts included with an order must be returned if the associated qualifying purchase is returned.

If promotional items are not returned, their value may be deducted from the refund.

16. Intellectual Property

All content on the Dark Frog TCG website, including logos, images, text, graphics, branding and software, remains the property of Dark Frog Studios or its licensors.

No content may be copied, reproduced, distributed, or used without prior written permission.

Magic: The Gathering, Pokémon, Disney Lorcana, One Piece and all related trademarks remain the property of their respective owners.

17. Limitation of Liability

To the maximum extent permitted by law, Dark Frog TCG shall not be liable for indirect, special, incidental, or consequential damages arising from:

  • Use of the website;
  • Delayed delivery;
  • Manufacturer defects;
  • Market value fluctuations;
  • Product availability issues.

Nothing in these Terms limits liability that cannot legally be excluded under Dutch law.

18. Force Majeure

Dark Frog TCG shall not be liable for failure to perform obligations resulting from circumstances beyond reasonable control, including:

  • Natural disasters;
  • Government actions;
  • Strikes;
  • System failures;
  • Internet outages;
  • Carrier disruptions;
  • Supplier shortages.

19. Fraud Prevention

We reserve the right to investigate suspicious transactions.

Orders reasonably believed to involve fraud, abuse, chargeback abuse, reselling violations, or criminal activity may be canceled and, where appropriate, reported.

20. Privacy

Personal data is handled in accordance with our Privacy Policy and applicable GDPR regulations.

21. Governing Law

These Terms of Service are governed exclusively by the laws of the Netherlands.

Any disputes shall be submitted to the competent court in the Netherlands unless mandatory consumer protection laws provide otherwise.
